You have to understand that the legal system, attempts to work out what happened, without being there, without knowing who the person is, what they are like etc, based on what people think they saw, or what some scientific evidence says.

The problem is that there is always the chance the evidence points to guilt, and a person is found guilty. Yet later on, we find they are innocent. You cant take back the death penalty once its been acted on.

Death is permanent. Some might argue a death penalty makes us no better than the criminals, I dont necessarily agree with that. But I do agree that the system is flawed in that it finds innocent people guilty from time to time and therefore a death penalty is not suitable. But life, should mean life and we should just accept that will cost money.
