Default getting caught with alcohol.

hey everyone,
what do you think would happen if i was pulled over by the police, bretholised and blew zero, and they saw i have alcohol in my car?
yes i know im 17 and underage blah blah blah but who started drinking at 18??

so yeah, im thinking of going out tonite and was wondering what the cops could do if I had un-opened alcohol in my car?

and no i wont drink and drive, the place im going is infact behind a police station, and me mates dad is the sargeant of this particular town, he will confiscate the keys off me no matter what after ive had a drink.
and lol thats why i got a panno so i can sleep in it!

as long as its not open there is no problem with it. open alcohol in a car is illegal afaik.

I know its illegal to have open alcohol containers in NSW, but it is not illegal in the ACT. It is however illegal to ride a sheep while under the influence in the ACT (I can post the legislation which specificaly says this if anyone is interested)

Unless WA has different laws, cant see why it would be illegal to transport unopened alcohol even if you are 17. To be on the safe side, ring your mate's Dad?

Sweet FA i would imagine, otherwise everyone would have to walk the groceries home whenever they were at woolworths and picked up a slab!!!

What similar laws apply to vic? What's a toy carriage? Does anyone have a toy carriage for sale? Might just be enough to get me home...

ha ha ha, ill pay that one. Nah mate, a "roady" is the one bottle required to help reduce the pain i seem to get from work until i get to the accomodation where there is alot more remedial bottles waiting (and no bloody jokes about other "remedial" substances you can easily get in Canberra!!)

and if i get pulled up ill just be nice and polite anyway, i reckon thats the best way to get through with the cops, talk about the footy or cricket or sumthing.

The reason there is no open-bottle rule in ACT is so the politicians can have mini-bars in the back of the commonwealth cars for the 15 minute drive to the airport

Sorry mate, but I can say to you that I am very sure unopened bottles are completely OK to have. Of course if a cop pulls you over and suspects that you are consuming alcohol they might take the bottles from you, but there cant be any charges laid. If you are that worried about it, carry the alcohol in the boot that way there is a clear distinction (they wont see it back there anyway unless they do a search - and if they do that you were prob being a ****er anyway). If it was illegal to have sealed containers, wouldnt drive-thru bottle shops be illegal??

Otherwise from my experience just treat the cops with respect and politeness and they will happily treat you the same (and resist the urge to ride that bloody sheep across the front of parliament house!!!)

One thing i do know is DO NOT DRIVE HOME. Either drink or drive, dont try and do a balancing act and do both (I have lost a mate in a car crash and it is not worth it)

yeah lol i know u can drive with un-opened bottles but since im 17 i was just wondering what they would do, i got pulled over a month ago and they searched my front cab for alco/drugs, although he just knelt in and had a peak (i could of had 10cartons and 20ounces of marijuana) and he wouldnt of seen them.
oh by the way im not into drugs that was just hypothetical.

oh and i wasnt being a ******** so thats why he only had a look in my cab.
(i have a feeling he just wanted to check my car out lol) dont see to many XB pannos rolling around...

I always thought that any alcohol had to travel in the boot?? Might have dreamt it and decided to run with it...... I do that sometimes.

I believe that is or was the law in Victoria at some stage.

As far as i know it is illegal to purchase alcohol and consume alcohol, but i dont think possession is against the law. Same as smokes
