Exclamation People who lend cars for weddings may face jail

So. How are things going in SA?

http://www.abc.net.au/news/stories/2...17/3068895.htm

Quote:
A threat has been made to prosecute people who have lent their cars to family or friends for weddings.

Family First MP Robert Brokenshire says several of his constituents in Adelaide have received warning letters after their cars were photographed being used for weddings.

He said a letter from the Transport Department claimed the car owners were running transport passenger services without accreditation, which carries penalties of up to four years' jail or a $15,000 fine.

The owner of a vintage car said he was shocked to get a letter threatening to prosecute him for lending it to a family friend for a wedding.

Kevin May says he had been warned of the risk of jail or a fine for lending his 1969 XW GT Falcon to a bridal party.

He is demanding the warning be withdrawn immediately, saying it is an infringement of his human rights.

"I was quite upset about it at first - I thought it was a joke - and then when I studied the letter properly, you could see it had numbers on there and it was definitely an official letter and I thought 'God, blimey charlie, I was only trying to help someone out'," he said.

"I wasn't trying to get a fine - $15,000 is a lot of money."

Mr Brokenshire said the SA Government had gone mad.

"It's one thing to be out there catching rogues ... that are impersonating accredited hire car companies but when a family friend lends the Subaru or the Ford Falcon to a friend for a wedding and they receive a demanding prosecution letter, it's absolutely outrageous," he said.

"Are the Government so tight with financial management at the moment that they're hitting innocent people with significant fines?

"I mean this is absolutely wrong. A person should be able to lend their car legitimately to a friend for a wedding without intimidation or fear of a fine or prosecution."
Absolutely ridiculous if true.

Its only "running transport passenger services without accreditation" if the cars are PAID for...

The same law applies if you drive into the city at night, crusing the streets and asking someone random if they want a lift home for cash... (basically an off the books taxi service)...

Otherwise its no different than you or I putting ribbons on a car and driving down the street... Its not illegal...

If the cars were 'hired' then there is something to answer to...

Otherwise... cash under the table or a slab of beer... no laws are broken...

*(I say this with experience as a wedding chauffeur for the last 5 years... and I have been pulled over and discussed this with the Police & Taxi Authority)*

would the same thing happen if you used your own car (ie. not borrowed from a friend) ?

sounds bloody insane!

This is just plain utter stupidity.

What benefit is there to fine a friend for using your car for FREE to be used at a wedding/private ceremony other than just placing ludicrous nanny laws which will end up being exploited beyond comprehension?

God I hate this state sometimes.

I suspect you will find it is just a nutter public servant flexing his muscles and will shortly get a kick up the bum.

This sort of thing has happened before.

e.g.
New years eve.....no one can pick up pax...absolute chaos...ok we will just look the other way.
Illegal to flash oncoming traffic....can't warn of accident or cow on road....radars are only in dangeous places and not for revinue raising so warning slows people down...flashing ok.
Airport security risks....Birdsville races chaos....Birdsville exempt during races.
Limos can't pick up from ranks.....xmas/new year/whatever chaos....blind eye used.

Or my favorite one:
1997 semi auto rifles completely prohibited import.
QLD corrective services & police apply for rifles, get knocked back by customs and are basically unarmed other than handguns.
Brenden John Abbott escapes from jail in a spectacular armed incursion by accomplaces carrying and discharging high powered automatic weapons.
Customs get bum kicked and offending officer sent on "gardening leave".....

Don't stress the little stuff.......

Nothing illegal about it unless the car is paid for... and even then how do they prove a cash payment between friends??? or a slab of beer ?? Or a full tank of petrol??

How can they be "paying" customers if they are friends or family?
Its like when we were younger and went on long drives somewhere our mates would chip in for petrol.....

Much ado about nothing from the Transport Dept....

The guy is right it is an infringement of his human rights, why ? because there is no Australian Bill of Rights, we are one of the only free countries that doesn't have one on par with the American Bill of rights.

And the Rann Labour Government knows this and is using it against you...
And will continue too.

I'm curious as to if there is any video/news footage of this incident? I'm really interested in armed jail breaks/robbery documentaries.

Cool threats for lending a car

Maybe just maybe this is something from ACA or such half a story
here in QLD if you have restricted rego (club rego)
then you can not hire your classic car out for money
but you can use it for a wedding
but only for your close family such as a daughter or sons wedding
but cant be used for uncles and aunties or grand parents
only the imediate family
so are we getting the full story
did he have his classic on club rego or what ever they call it in SA
and went outside the guide lines
who knows
thanks John

Just google Brendan James Abbott.
There was one of those true crime shows (Ch9 I think) that detailed the life and crimes of Brendon Abbott.

Could also search postcard bandit.

An American style Bill will not make muster here, guaranteed. Particularly say second Amendment (right to bear arms), fundamentally I don't have a problem with that US 'right'. (I also support a states right to militarise its police forces - vis a paramilitary, as a hedge against potential federal threat and insofar its desire to assume authority over state sovereign Constitutional power and affairs, AND against another state).

The Magna Carta has a place in Australia's sovereign states, as does the 1688 Bill Of Rights, but in a couple of court cases, one going back to 1905, and a couple more recent, have seen the high court allow parliaments to pass legislation contrary to each of these two hisorically important 'protections'.

Victoria's Bill Of Rights, is leftist written porridge, it supports garbage like multiculturalisim that countries like Germany have recently been ridding itself of. (Doesn't work). It is subservient to UN Convention, and lets face it - because we (Australia) 'contract' many UN Conventions; any national one will be as well!

Our Australian Constitution is often paid mere lip service by Canberra and some state parliaments, and then duly ignored as the 'reformer' see's fit. Its weak - in that it gave us the right to do or say almost anything that didn't fall foul of part of it, OR if a government passed legislation that in some way restricted 'freedom'.

Our elected MP's take either an oath or affirmation to uphold it and our inherited rights. So many of these activists set about removing vestiges of monarchy (pictures, rods, seals etc).

A lot of anger in AUS, I can see much more in the years ahead arising from tjhe ongoing PC 'reformist' agenda, from 'issues' arising like the republic, flag, heritage and identity etc.

This thread is one example of the ongoing clamp on your daily life abilities, albiet in SA in this case.

Tic tic tic as they say. (Rem; if you start framing "rights" in these modern times- you risk very much, invariably limiting freedom).
